Consent & Authorization Agreement — Hushsong (DRAFT)

By proceeding, you confirm, represent, and agree to the following. These are the things you affirm before any keepsake is created.
1. Relationship & authority
☐ The person depicted is my family member, or someone I am legally authorized to represent (for example, as next-of-kin, executor, or estate representative).
2. Rights to the likeness and voice
☐ I have the right to use this person's photographs and voice recordings to create this keepsake, and doing so does not violate anyone's rights.
3. Understanding it is AI-generated
☐ I understand the keepsake is AI-generated, is not a real recording of the person, will be clearly labeled as AI-generated, and reflects a message I wrote.
4. Biometric consent
I give my express, informed consent for Hushsong to process the face and voice (biometric information) in my uploads solely to create and deliver my keepsake, as described in the Privacy Policy, including a short-lived voice clone used only for my order.
5. Limited licence
I grant Hushsong a limited, revocable licence to use my uploads only to produce and deliver my keepsake and to keep a record of this consent. I can request deletion at any time.
6. Representations & warranties
I represent and warrant that the above statements are true and accurate, and that my use complies with the Acceptable Use Policy.
7. Indemnification
I agree to indemnify and hold harmless Legion Trade Corp. (operating as "Hushsong") from any claim, loss, or expense arising from a breach of these representations — including any claim that I did not have the right to use the person's likeness or voice.
8. Record of consent
I understand Hushsong will record this consent (my confirmations, email, timestamp, and technical details such as IP and device) and retain it as described in the Privacy Policy.
