Terms of Service — Hushsong (DRAFT)

By using Hushsong you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and the Consent Agreement you accept at checkout.

1. Who can use Hushsong

You must be at least [18] and able to form a binding contract. The service is offered only in [supported regions].

2. What the service is

Hushsong generates an AI-created keepsake — a short video in which a likeness of a person you provide speaks a message you write. The output is artificial. It is a remembrance, not a real recording of the person, and it is labeled as AI-generated.

3. Guest checkout, payment, and refunds

We offer guest checkout (no account). You provide an email for your receipt and delivery link.
Payment is processed by our third-party payment processor; their terms apply to the payment.
Pricing is shown before purchase. [Refund/satisfaction policy — e.g., if the keepsake fails to meet a stated quality standard we will remake it or refund; lawyer to confirm enforceability for a digital good.]

4. Your content and the rights you grant

You retain ownership of what you upload. You grant us a limited, revocable licence to process your uploads solely to create and deliver your keepsake, and to retain a consent record. You make the representations and indemnities in the Consent Agreement (incorporated by reference).

5. Acceptable use

You must comply with the Acceptable Use Policy. Prohibited content/use (including public figures, living persons without consent, minors, hateful, sexual, deceptive, or unlawful content) may be refused, removed, and result in termination and reporting where required.

6. Intellectual property

The Hushsong name, software, and site are ours. You may not copy, resell, or reverse-engineer the service.

7. Disclaimers

The service is provided "as is." We do not warrant that an AI keepsake will match your expectations, that a likeness or voice will be accurate, or that the service will be uninterrupted or error-free, to the extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim is limited to [the amount you paid for the relevant order], and we are not liable for indirect, incidental, or consequential damages. [Lawyer to confirm enforceability under Ontario consumer-protection law; do not over-disclaim non-excludable rights.]

9. Indemnification

You agree to indemnify us against claims arising from your content or your breach of these Terms or the Consent Agreement (including claims that you lacked the right to use a person's likeness or voice).

We may suspend or end access for breach or to comply with law.

11. Governing law
